Terms and conditions of sale

Last updated: 19 October 2026

Article 1 — Identity of the seller

The website noctua-paris.com is operated by YBH GROUP LTD, a Private Limited Company incorporated under English law, registered in the companies register under number 17391906, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.

Trading name: Noctua Paris
Email: contact@noctua-paris.com

Article 2 — Purpose and scope

These general terms and conditions of sale govern distance sales concluded on noctua-paris.com between YBH GROUP LTD and any customer acting as a consumer. They are available before the order is placed, and acceptance is required to confirm the purchase.

Article 3 — Products

The essential characteristics, materials, dimensions, colours, care instructions and prices are stated on each product page. The customer must read them before ordering. Photographs reproduce the products as faithfully as possible; minor differences in colour due to screens or production batches may occur.

Offers remain valid while displayed on the website, subject to availability. If an item becomes unavailable after an order is placed, the customer is informed without delay and refunded the amounts paid for the unavailable item.

Article 4 — Prices and taxes

Prices are stated in euros, inclusive of all taxes and exclusive of delivery charges. The applicable charges and the total amount payable are displayed before final confirmation of the order. The price charged is the price displayed when the order is placed.

YBH GROUP LTD may change its prices for future purchases, without affecting orders already confirmed.

Article 5 — Orders

The customer selects the products, checks the contents of the basket, contact details, delivery and total price, corrects any errors if necessary, accepts these terms and conditions of sale and then confirms the order with an obligation to pay. An acknowledgement of receipt is sent by email and summarises the contractual information.

YBH GROUP LTD may refuse or cancel an order in the event of suspected fraud, a payment incident, an obvious pricing error or a previous payment dispute, subject to the consumer's rights.

Article 6 — Payment

Payment is made using the methods offered when placing the order. The amount is due when the order is placed. Payments are processed by the providers displayed at the time of payment. YBH GROUP LTD does not have access to the customer's full banking details.

Article 7 — Delivery

For deliveries to mainland France, standard delivery costs €6.90 for orders below €80 and is free on orders of €80 or more.

For deliveries within the European Union outside France, including Belgium, standard delivery costs €6.90 for orders below €80 and is free on orders of €80 or more. The charge and threshold are converted into the checkout currency where necessary. Charges for other destinations are shown on the Delivery and returns page.

Delivery areas, methods, charges and times are stated on the Delivery and returns page and summarised before payment. Unless otherwise stated on the product page, delivery takes place no later than 15 working days after confirmation of payment.

In the event of a delay, the consumer benefits from the remedies provided by law, including the ability to require delivery within a reasonable additional period and then, if delivery does not take place, to terminate the contract. The risk of loss or damage passes to the customer when they take physical possession of the goods, except where they have chosen a carrier other than those offered.

Article 8 — VAT and total amount

For deliveries to France and the European Union, the total amount due is shown before payment. This amount is the final price: no additional charges are requested from the customer upon delivery. For deliveries outside the European Union, local taxes or duties may be payable by the recipient; this information is provided before the order is placed where applicable.

Article 9 — Right to cancel

The consumer has 14 calendar days from the day after receiving the goods to notify their decision to cancel, without giving a reason. For an order delivered in several lots, the period starts upon receipt of the final item or lot.

Cancellation may be notified by any unambiguous statement sent to contact@noctua-paris.com, or using the model form in Article 10. An acknowledgement of receipt is sent by email. The products must then be dispatched within 14 days of notification to the return address provided by customer service.

The customer remains responsible for direct return costs, unless Noctua Paris made an error, the product is defective or otherwise stated. The customer is responsible only for any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

The refund includes the price of the returned products and, where the entire order is cancelled, the original standard delivery charges. It is made within 14 days of the cancellation notice, using the same payment method, unless otherwise agreed. YBH GROUP LTD may withhold the refund until the goods are received or proof of dispatch is provided.

The right to cancel does not apply to goods made to the customer's specifications or clearly personalised, or to sealed goods that cannot be returned for health or hygiene reasons where their seal has been removed after delivery. This exception is interpreted strictly and does not automatically exclude all bed linen that has merely been unpacked.

The statutory guarantee of conformity applies for two years from delivery of the goods. In the event of a lack of conformity, the consumer may request repair or replacement of the goods, subject to the legal requirements of cost and proportionality. If bringing the goods into conformity is impossible, refused, takes longer than the statutory period or causes significant inconvenience, the consumer may obtain a price reduction or terminate the contract under the conditions provided by law. YBH GROUP LTD is responsible for the proper performance of its obligations in accordance with applicable law. It cannot be held liable in the event of improper use, care contrary to the instructions, force majeure or an unforeseeable and insurmountable act of a third party, without limiting statutory guarantees or the consumer's mandatory rights.

Article 14 — Personal data

The processing of personal data is described in the Privacy Policy. Rights of access, rectification, erasure, restriction, portability and objection may be exercised at contact@noctua-paris.com.

Article 15 — Intellectual property

The mediator's name, address and website will be added here once the company's membership is finalised.

These terms and conditions of sale are governed by the law applicable to YBH GROUP LTD, without depriving the consumer of the more protective mandatory provisions of their country of habitual residence. The consumer may bring proceedings before the competent courts in accordance with the applicable legal rules.
